Terms and Conditions of Sale
Preamble
These Terms & Conditions govern the sale of products offered by Outseam.
Outseam is a private limited liability company, with its registered office located at:Rua Aval de Baixo 238, 4200-103 Porto, Portugal.
Article 1 – Scope of Application
These Terms & Conditions apply to all contractual relationships between Outseam (accessible at https://outseam.shop) and any person making a purchase through the website (the “Customer”).
By placing an order and/or creating an account with Outseam, the Customer confirms full and unconditional acceptance of these Terms & Conditions by ticking the relevant acceptance box.
Outseam undertakes to comply with its obligations under these Terms. Outseam reserves the right to modify these Terms & Conditions at any time. The version applicable to the Customer is the one in force on the date the order is placed.
Article 2 – Registration & Account
Access to products on the website does not require registration, except during special promotional periods.
Where registration is required, membership is granted only after identity confirmation. Outseam reserves the right to accept or reject any registration request and to modify access rights at any time.
Once registered, the Customer receives a confirmation email and gains access to a personal account. The Customer is solely responsible for keeping login credentials confidential. In case of loss or disclosure, the Customer must reset their password immediately.
During registration, Customers may opt in to receive sale invitations, newsletters, and partner offers by email. Consent may be withdrawn at any time.
Article 3 – Products
Outseam provides detailed descriptions and photographs of all products. Product characteristics are based on information supplied by manufacturers or suppliers.
Outseam strives to display products as accurately as possible; however, slight variations may occur. Customers are encouraged to report any inaccuracies.
Products are offered while stocks last and for an indefinite period.
Article 4 – Prices
All prices are shown in EUR (€) and include applicable taxes.
Shipping costs are not included unless stated otherwise and depend on the destination country.
Shipping fees are displayed at checkout and must be confirmed by the Customer. If shipping is indicated as free, no delivery fee will be charged.
Outseam reserves the right to change prices at any time. Products are invoiced at the price in effect at the time the order is placed.
Article 5 – Order Process
Orders may only be placed via https://outseam.shop.
The Customer confirms that they have the legal capacity to place an order and are at least 18 years old or otherwise legally authorized to purchase.
The Customer guarantees that the payment method used belongs to them and has sufficient funds. Any order placed on the website is deemed to be made by the account holder.
All data recorded by Outseam constitutes proof of transactions.
An order becomes binding once payment is confirmed and an order confirmation email is sent. This confirmation constitutes the sales contract.
Orders are forwarded immediately to the logistics center and generally cannot be cancelled prior to shipment. This does not affect the Customer’s statutory right of withdrawal within 14 days, except for personalized or made-to-order products.
Article 6 – Payment Terms
Payment is made by credit or debit card via a secure payment system.
Orders are processed only after payment authorization by the bank and subject to product availability. If payment is declined, the order is automatically suspended.
Outseam reserves the right to refuse orders where a dispute with the Customer is unresolved.
Refunds following payment failure are processed without undue delay and no later than 14 days.
Article 7 – Payment Security
Outseam uses SSL (Secure Socket Layer) encryption to protect payment data. No sensitive payment information is stored by Outseam.
Card details are handled exclusively by partner banks and payment providers, which apply advanced fraud prevention systems.
Article 8 – Product Availability
In rare cases, a purchased product may become unavailable. If this occurs, Outseam will notify the Customer by email within one week.
In case of total unavailability, the Customer will be offered an exchange, store credit, or a full refund within 14 days of contract termination.
Article 9 – Delivery Conditions
Orders are shipped primarily from Portugal. Delivery times depend on destination and shipping method:

Standard delivery: 1–3 weeks

Express delivery: 3–7 days

Postal delivery: 1–3 days
Delivery is made to the address provided at checkout. If delivery fails due to Customer-related reasons (incorrect address, failure to collect, refusal, unpaid customs duties), Outseam may deduct incurred costs from any refund.
Customers should report damaged or incomplete deliveries as soon as possible (preferably within 48 hours) with photos. This does not affect statutory rights.
Shipping fees are non-refundable.
Customs Duties
Outseam is not responsible for customs duties, taxes, or import charges. These are the responsibility of the Customer.
Article 10 – Right of Withdrawal, Returns & Refunds
Right of Withdrawal
Consumers may withdraw from the contract within 14 days of receiving the goods, without providing a reason. Notice must be sent to mail@outseam.shop.
Return of Goods
Returned items must be sent within 14 days of withdrawal notice. Customers may inspect goods as in a physical store; excessive use may reduce refund value.
Refund
Refunds are issued within 14 days of receiving returned goods, excluding original shipping costs.
Article 11 – Warranty & Liability
Products must conform to contract terms under consumer protection law. In case of defects, Customers may request repair, replacement, or refund within statutory periods.
The warranty does not cover damage due to misuse, improper care, or normal wear and tear. Personalized or washed items are non-refundable.
Outseam is not liable for indirect or consequential damages. Liability is limited to the value of the ordered products.
Product images are illustrative and minor variations do not constitute defects.
Article 12 – Intellectual Property
All content on https://outseam.shop (texts, images, logos, videos, designs) is protected by copyright and is the exclusive property of Outseam or its partners.
Any reproduction, distribution, or use without prior written consent is strictly prohibited and may result in legal action.
Article 13 – Personal Data & Privacy
Outseam acts as data controller and processes personal data in accordance with applicable data protection laws (GDPR).
Data is collected for order fulfillment, payment processing, customer support, accounting, fraud prevention, and marketing (with consent).
Customers have rights of access, rectification, erasure, restriction, portability, and objection. Requests may be sent to mail@outseam.shop and will be handled within 30 days.

Article 14 – Governing Law & Jurisdiction
These Terms are governed by Portuguese law, without prejudice to mandatory consumer protection laws of the Customer’s country of residence.
Consumers may bring claims before courts in their country of residence. Disputes may also be submitted to alternative dispute resolution bodies (RAL) listed by the Portuguese Directorate-General for Consumers.
